While that's ideal, I'd rather they be gone in case the war goes south and he gets released, only to be awarded a medal of honor by Russia for betraying the country.

Google says that Ukraine doesn't do the death penalty- they do life imprisonment in the case of "high treason" from what I found, but I could be wrong.

Right, but the point is- I can't find anything that substantiates your claim. The only sources I can find all say "life imprisonment." Have you read somewhere that they allow for the death penalty under martial law? Because otherwise, you're just making things up.

Usually when a sane country repels the death penalty it applies to all codes, not just the civilian ones.

Belarus is the only European country still employing the death penalty.
And yes, that supposedly includes Russia. Albeit it's not illegal per se, there's just a moratorium on it — while we know that unofficially when "falls out a window", what has actually happened.
