They know they shouldn't be doing this, they know the real legality of this. Judges across the country are not responding well to this obvious retaliatory behavior by the government, and are dismissing these cases left and right.
"I was only following orders" is not a valid defense in court. These MAGA marauders are eventually going to find that out.
