In the US, the police can act on whatever charge they want, if they just think that something illegal is happening whether it is illegal or not.
So being a lawyer and knowing every statute on the books won't help you unless you know to shut up, ask if you're being detained/arrested, if you are then you can't beat the ride but you can beat the case later if you don't give them enough to go off of.

Then he has the cop come out and goes "So did I get anything wrong?" and the cop absolutely corroborates everything he said.
I mean, it's right there in the Miranda warning "Anything you say can and will be used AGAINST YOU". Not for you, not to exonerate you, AGAINST YOU.
So what do you do?
