You're right that this only works until it gets overturned by SCOTUS, and it doubly hurts progressives because we now have to spend resources (time and money) fighting nonsense instead of fighting for causes we want...like some goddamn healthcare.
But it creates the pretext that the results will be different than the polls were and gives him cover to raise all the election interference claims that you know are coming.
