In a case that dates back to 2023, a man approached a woman at a bus stop in Madrid, kissed her hand and made gestures to suggest she follow him and that he would pay her.
That's more than just "kissing a hand". Of course approaching women at a bus stop, kissing them and offering to pay them for sex is wrong.
However, in its ruling, the Supreme Court found that the encounter had exceeded mere harassment, stating that there had been "a clear sexual component because he even kissed [her hand]
Kissing the hand was what made it go from harassement to assault. So the Headline does portray the ruling correctly.
To play devil's advocate, the supreme court ruling explicitly mentions the act of kissing the hand as to why they classify this as sexual assault, instead of just harassment.
For guys (and girls) who feel confused: ask them first if it is okay to do something or touch their bodies. If they say yes, you are in the clear. If they say no, then back off. This includes if you are trying to do a joke or prank. Touching someone as a "joke" is still harassment if you don't have consent.
