Is there a legal difference? Like if they are quashed does that constrain the government in some way?

I'm not a lawyer, but my guess is that this is more about publicly admonishing the DOJ lawyers to encourage them not to file them in the first place. There's a difference between telling someone "No" and telling someone "Are you fucking kidding me with this stupid shit?"
