There needs to be clause that say you can retroactively apply eligibility to the senate based on prior eligibility but systematic failure to let you run during the limited timeframe.

One minute beyond the deadline they will announce, "mitch was visiting the ole' Kentucky explosion factory today, not being a closeted homosexual, and in a freak accident, he exploded. So we're all super bummed that there can't be an autopsy now... Even if there could be of course, the results would just say he was definitely straight, and he was not dead for a month before his corpse living body was deliberately accidentally exploded."

If he's not dead dead, which admittedly seems like it would hard to keep secret for a month and a half, it seems pretty likely that he knows he isn't fit to serve and is simply waiting on announcing that until it's too late for the people of Kentucky to have a say about his successor. Which would, as many have noted, be a perfect way for this ghoul to end his career, fucking over his constituents one last time on his way out the door.
